The Supreme Court declares that the withholding of tax refunds intended for the payment of debts to third parties is subject to appeal

September 9, 2026

The Supreme Court has established doctrine on the withholding of tax refunds when the State Tax Administration Agency recognizes an amount in favor of the taxpayer, but reduces or neutralizes its payment to cover debts with third parties or mandates from the Administration of Justice.

The referenced ruling is that of July 15, 2026, appeal no. 3984/2024, whose criterion was subsequently reiterated by resolutions of July 22 and 23, 2026. The relevance of this doctrine lies in the fact that the so-called “payment notification for refund” can no longer be treated as a mere informative action when it alters the net amount that the taxpayer actually receives.

Legal conclusion: If the tax authorities acknowledge a refund but apply a deduction or withholding that reduces the amount to be received, this action is subject to challenge through administrative channels. Furthermore, the tax authorities must provide justification for the withholding and include in the file the elements that allow for understanding and verifying its basis.

Resolution and question raised before the Supreme Court

Reference judgment: appeal no. 3984/2024

The main ruling comes from the Administrative Law Chamber, Second Section, of the Supreme Court. In the case examined, the Spanish Tax Agency (AEAT) had issued a notification of refund of undue payments and, at the same time, had withheld the recognized amount to cover a debt owed by the taxpayer to a court.

The taxpayer filed an economic-administrative claim, but the Central Economic-Administrative Court considered that the communication did not constitute an act susceptible to challenge, understanding that it was a procedural or merely informative action.

The issue was not the validity of the court debt

The central issue was not whether the tax authorities could review the legality of a court order. The question was different: whether the way in which the Spanish Tax Agency (AEAT) applies that order to a recognized tax refund can be subject to review through administrative channels.

This distinction is essential to understanding the scope of the doctrine on withholding tax refunds.

Established doctrine on the withholding of tax refunds

The communication that alters the amount to be charged is contestable

The Supreme Court concludes that the so-called payment communication, when it incorporates deductions and ends up altering the net amount recognized in favor of the taxpayer, meets the requirements to be subject to economic-administrative claim.

Therefore, a withholding of tax refunds cannot be left out of control simply because it is formally presented as a payment notification.

The Administration must provide reasons for withholding funds

When the Spanish Tax Agency (AEAT) applies a deduction that totally or partially absorbs the amount to be refunded, it must justify the decision and include in the file the necessary elements to justify it.

If the withholding stems from a seizure or court order, the Administration cannot review the legality of that court decision, but it must explain which order it applies, how it applies it, and how it affects the recognized tax credit.

That aspect of the administrative action is subject to economic-administrative control and, subsequently, jurisdictional control.

What changes for the taxpayer

The new doctrine strengthens taxpayer protections when tax refunds. The tax authorities cannot simply state that the amount is being used to pay a debt to third parties without providing sufficient supporting documentation.

Right to know the basis for the unpaid amount

The file must allow for the identification of the legal basis for the withholding and verification of how it was applied to the recognized refund. This justification is especially important when the amount actually paid does not match the previously recognized refund.

Effective economic-administrative control

The procedural consequence is equally relevant: the communication can be challenged. The economic-administrative body cannot reject the claim solely on the grounds that it is an informational communication or the mere execution of a third-party order.

Time limit and ways to appeal the withholding

In the event of a communication that applies a withholding of tax refunds, the taxpayer may choose between the ordinary review procedures provided for in the General Tax Law.

Optional appeal for reconsideration

An appeal for reconsideration may be lodged with the body that issued the decision within one month of notification. The statutory period begins on the day following notification of the decision being appealed.

Economic-administrative claim

An economic-administrative claim may also be filed with the competent economic-administrative court within one month of notification.

The two paths are alternatives at the outset. If an appeal for reconsideration is filed, an economic-administrative claim regarding the same act cannot be simultaneously pursued until the appeal for reconsideration has been expressly resolved or can be considered rejected by silence.

Critical deadline: when the refund received does not match the recognized amount, it is advisable to review the communication within one month of its notification to determine whether an appeal for reconsideration or an economic-administrative claim is appropriate.

Relevance for non-residents and international structures in Mallorca

The doctrine on withholding tax refunds has a special practical impact on non-resident taxpayers, foreign investors and groups with cross-border activity.

IRNR files

This may be relevant in cases related to Non-Resident Income Tax, including cases related to forms 210 and 211, when there is a recognized refund whose final payment is lower because a withholding or deduction intended for third parties has been applied.

VAT refunds for non-established businesses

It may also affect VAT refunds from non-established businesses or professionals and undue income recognized after an audit or review procedure.

For taxpayers with assets, real estate investments, or economic activity in Mallorca but residing outside of Spain, the response time can be particularly demanding. The withholding of tax refunds should be reviewed not only from the perspective of the debt that originated it, but also from the sufficiency of the justification and documentation provided by the tax authorities.

What to check when receiving a return communication with withholding

Amount recognized and amount actually paid

The first analysis should compare the recognized refund with the amount actually transferred to the taxpayer. Any discrepancies must be explained in the file.

Title that justifies the withholding

The judicial or administrative order that serves as the basis for the deduction must be identified and it must be verified how it has been applied to the specific refund.

Sufficient motivation

A generic reference to "debts with courts" or obligations with third parties does not replace the obligation to explain how the title affects the amount that the AEAT had to return.

Deadline for appeal

The one-month deadline from the notification requires a quick review of the file, especially when the taxpayer is outside of Spain.
